Every year, thousands of people die from taking prescription and over-the-counter drugs. While most medications are safe, the FDA is forced to issue recalls for hundreds of risky drugs. Although the FDA is in charge of monitoring and regulating the safety and efficacy of all drugs in the United States, it has recently come under fire for not being thorough enough in its evaluations. The FDA has been accused of approving some drugs before they have been thoroughly tested and as a result, many innocent people have been severely injured or have died.

The most recent class of prescription drugs to be targeted by the FDA are known as COX-2 inhibitors and include the painkillers Vioxx®, Celebrex®, and Bextra®. While these drugs have been shown to be effective anti-inflammatory agents, they are also now known to significantly increase the risk of heart failure, high blood pressure, and stomach ulcers. Hundreds of lawsuits have been filed against the makers of the drugs for the injury and death of loved ones.

Antidepressants have been the target of much concern since more than a year ago the FDA mandated that all such drugs carry a warning label disclosing their link with suicidal tendencies in young people. Many lawsuits are currently filed against the manufacturers of antidepressants by patients and shareholders alike due to allegations that makers hid such a link. Some of the drugs that are under scrutiny are Pfizer’s Zoloft®, GlaxoSmithKline’s Paxil®, Wellbutrin®, and Zyban®, and Eli Lilly’s Prozac® and Cymbalta®.

Strengthened by the Republican presidential victory in 2004, Congress passed a bill in February 2005 that is similar to one proposed during George W. Bush’s first term. Under prior law, attorneys could bring lawsuits in either state or federal courts, giving them the flexibility to decide which forum would benefit their clients. The new class action law restricts many class action cases to the federal courts only. This change reduces the ability of injured people to hold powerful interests accountable in local courts. More recently, Congress has been gearing up new restrictions that seriously reduce the amount of compensation a patient may receive when injured by a negligent doctor or nurse.

President Bush recently signed new legislation that will severely inhibit Americans’ ability to escape debt through Chapter 7 bankruptcy protection. Many analysts translate the bankruptcy reform as a win for corporations and creditors, as those in debt will be required to pay back much of what was previously allowed to be written off. Experts say this will most significantly affect lower income families, single mothers, minorities, and the elderly who are already at a greater financial strain. The bill will remove a safety net for these groups of people who suffer the loss of a job or face mounting medical bills. The bankruptcy changes took effect in mid-2005. Major repercussions are expected to surface over the next several years.
