Medical Malpractice

Both locally and nationally, juries vote for the medical provider in about 80 percent of medical malpractice trials. This makes it extremely important that your medical malpractice case be handled by a firm that is skilled and experienced in this difficult and challenging area of practice. The phrase “medical malpractice” simply means medical negligence. Just as every driver must obey the rules of the road, every doctor, nurse, and hospital must obey the rules of the medical road. When a driver runs a red light and causes a collision, the driver is legally responsible. Likewise, when a medical provider falls below the standard of care, that provider is legally responsible for injuries caused by that negligence.

The patient must prove three things in a medical malpractice case:

• The medical provider fell below the standard of care
• The patient was injured
• The patient’s injuries were directly caused by the medical negligence

To be negligent, medical conduct must fall below the standard of care. For a doctor, the standard is what a doctor of ordinary skill, care, and diligence would do under similar circumstances. A bad or unexpected outcome does not necessarily mean that a medical provider was negligent.
